NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER AND FOR THE PURPOSES OF SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT, 1966, AS AMENDED BY SECTION 198 OF THE RESIDENTIAL TENANCIES ACT 2004, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO.2) ACT, 1960 SUBSTITUTED BY SECTION 86 OF THE HOUSING ACT, 1966, AS AMENDED BY SECTION 6 AND THE SECOND SCHEDULE TO THE ROADS ACT, 1993 AND AS AMENDED AND EXTENDED BY: THE PLANNING AND DEVELOPMENT ACTS, 2000-2020 (INCLUDING PART XIV, SECTION 213, SECTION 213(2) AND SECTION 222 THEREOF); LOCAL GOVERNMENT ACTS 1925-2019 INCLUDING SECTIONS 11 AND 184 OF THE LOCAL GOVERNMENT ACT, 2001; ROADS ACTS 1993-2015 AND PART XIV OF THE PLANNING AND DEVELOPMENT ACT, 2000 AND ALL OTHER ACTS, THEREBY ENABLING PUBLICATION  IN ACCORDANCE WITH ARTICLE 4(A) OF THE THIRD SCHEDULE TO THE HOUSING ACT, 1966 AS AMENDED.

 

COMPULSORY ACQUISITION OF LAND

CORK CITY COUNCIL – GRANGE ROAD TO TRAMORE VALLEY PARK PEDESTRIAN AND CYCLE LINK, ACQUISITION ORDER NO.2 OF 2021

 

Cork City Council (hereinafter referred to as “the local authority”) in exercise of the provisions of section 76 of the Housing Act,1966 and the third Schedule thereto, as amended by section 198 of the Residential Tenancies Act 2004, as extended by section 10 of the Local Government (No.2) Act, 1960 substituted by section 86 of the Housing Act, 1966, as amended by section 6 and the second Schedule to the Roads Act, 1993 and as amended and extended by The Planning and Development Acts, 2000-2020(including Part XIV, Section 213, Section 213(2) and Section 222 thereof); Local Government Acts 1925-2019 including sections 11 and 184 of the Local Government Act, 2001; Roads Acts 1993-2015 and Part XIV of the Planning and Development Act, 2000 and all other Acts, has made an order entitled as above which is about to be submitted to An Bord Pleanala for confirmation. If confirmed, the order will authorise the local authority to acquire compulsorily the lands described in the Schedule Part 1 hereto together with any easement, wayleave, water- right or other right over or in respect of the said lands or water or any sub-stratum of the said lands for the purposes of performing its functions under the Planning and Development Act, 2000 including giving effect to and facilitating the implementation of the City Development Plan. The order will also authorise the local authority to temporarily acquire the lands described in the Schedule Part 11 pending the completion of the works.

 

Owners, lessees and occupiers of the lands described in the Schedule Part 1 and Part 11, will receive individual written notice.

 

The Board cannot confirm –

 

a compulsory purchase order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land and not withdrawn, until it has caused to be held an oral hearing into the matter and until it has considered the objection and the report of the person who has held the oral hearing.

A copy of the order and of the map referred to in it may be seen between the hours of 9am to 5pm on working days between the 30th of April 2021 and the 11th of June                               2021 by appointment at Cork City Council, City Hall, Cork, by phoning 021/4924257 or 021/4924587.

 

SCHEDULE

PART 1

The lands to which the Order relates are described as follows: -

 

Schedule Numbers  1, 2, 3(A), 4, 5.

 

Starting at a point approximately 94 metres north of Grange Road and approximately 21 metres east of the Pond at Lakelands, Grange Road, thence in a north westerly direction for approximately 7 metres, thence in an easterly and south easterly direction for approximately 15 metres, returning to the starting point in a south westerly direction for approximately 11 metres.

Starting at a point approximately 100 metres north of the Grange Road and approximately 19 metres east of the pond at Lakelands, Grange Road, thence curving in a north easterly direction for approximately 15 metres, thence in a north easterly direction for approximately 17 metres, thence in a south westerly direction for approximately 24 metres, returning to the starting point in a north westerly direction for a distance of approximately 11 metres.

Starting at a point at the north western corner of “St. Gobnaits”, 6 Marian Terrace, Grange Road, thence in a northerly, north westerly and north easterly direction for approximately 632 metres to a point between Vernon Mount Moto Cross Park and Alden Grove Estate, thence in a southerly, south easterly and south westerly direction for a distance of approximately 626 metres to a point at the rear of “St. Gobnaits”, 6 Marian Terrace, Grange Road, returning to the starting point for a distance of 9 metres along the rear boundary of “St. Gobnaits”, 6 Marian Terrace, Grange Road.

Starting at a point approximately 85 metres south of the N40 and adjacent the Vernon Mount Moto Cross Park, thence in a northerly direction for approximately 2 metres, thence in a north easterly direction for approximately 15 metres, thence in a north westerly direction for approximately 54 metres, thence in a easterly direction for approximately 3 metres, thence in a south easterly direction for approximately 56 metres, returning to the starting point in a south westerly direction for a distance of approximately 16 metres.

Starting at a point approximately 83 metres south of the N40 and adjacent the Vernon Mount Moto Cross Park, thence in a north westerly direction for approximately 69 metres, thence in an easterly direction for approximately 19 metres, thence in a south easterly direction for approximately 54 metres returning to the starting point in a south westerly direction for a distance of approximately 15 metres.

Schedule Number   3(B)

 

Starting at a point approximately 133 metres north of the Grange Road and west of Amberley Estate, thence in a north westerly direction for approximately 3 metres, thence in a northerly, north easterly and north westerly direction for approximately 591 metres to a point between Vernon Mount Moto Cross Park and Alden Grove Estate, thence in an easterly direction for approximately 3 metres, returning to the starting point in a southerly, south westerly and south easterly direction for a distance of approximately 597 metres.
